This document details the conditions that govern the contracting, execution, modification and cancellation of the services offered by Galápagos Below Ocean School. A careful reading of these Terms and Conditions is a prerequisite for contracting any service. By making a reservation, you declare that you have understood and accepted each of the sections detailed below, in accordance with Ecuadorian law, the regulations of the Galápagos National Park, and the Special Regime of the province.

Al realizar una reserva, el Participante declara haber comprendido y aceptado cada una de las secciones detalladas a continuación, de conformidad con la legislación ecuatoriana, los reglamentos del Parque Nacional Galápagos y el Régimen Especial de la provincia.

Mit der Reservierung erklärt der Teilnehmer, jeden der nachstehenden Abschnitte gelesen und akzeptiert zu haben, gemäß ecuadorianischem Recht, den Vorschriften des Nationalparks Galápagos und dem Sonderregime der Provinz.

2.1 Reservations must be made through official channels (direct contact with Galápagos Below or an authorized partner agency). By placing a reservation, the Participant agrees to pay the full or partial amount as stipulated for each activity.

2.2 All prices are quoted and charged in US Dollars (USD). Unless otherwise stated, prices include applicable taxes. Payments may be made via bank transfer, cash, or credit/debit card. Card payments may incur a fee applied by the payment gateway.

2.3 For reservations made more than one month in advance, a minimum payment of 50% of the total amount is required to confirm the booking, exclusively through direct sales channels. For reservations made less than one month in advance, full payment (100%) is required. Any remaining balance must be settled at least 24 hours prior to the start of the activity.
2.3 Para reservas realizadas con más de un mes de antelación, se requiere un pago mínimo del 50% del importe total para confirmar la reserva, exclusivamente a través de canales de venta directa. 2.4 For certain services involving higher upfront operational costs (e.g., maritime transportation, water fees, hotel coordination), Galápagos Below may require a higher advance payment. Participants will be informed in advance.

2.6 If the Participant does not complete payment by the stipulated dates after receiving confirmation, Galápagos Below reserves the right to cancel the reservation and apply the relevant cancellation fees.

2.7 In the event of increased operational costs that were not foreseeable at the time the contract was confirmed (e.g., fuel, port taxes, park fees, tax changes, currency fluctuations), Galápagos Below may adjust the price accordingly.

2.8 Any price increase shall not exceed 8% per participant of the original contracted price. If the increase surpasses this limit, the Participant may: (a) accept the revised price, (b) switch to an alternative activity of equivalent value, or (c) cancel without penalty.

2.9 If the adjustment results in a reduction in value or quality of the contracted service, the Participant is entitled to a proportional reduction in price.

3.1 When making a reservation via electronic means (website, email, or WhatsApp), the Participant will be provided with a clear booking process and must verify all information before submission.

3.3 The contract is deemed confirmed once Galápagos Below sends a booking confirmation through a durable medium (email, PDF, or similar).

3.4 For non-electronic reservations (in person or by phone), the contract is formalized once written confirmation is provided on paper or through a durable medium.

4.1 Galápagos Below's obligation is limited strictly to the services, itineraries, and standards explicitly stated in the confirmed reservation and the initial offer.

4.2 No refunds, replacements, or compensatory services will be offered in cases of voluntary non-participation by the Participant.

4.3 All activities are carried out in legally authorized sites following Galápagos National Park regulations. Galápagos Below may adjust itineraries, schedules, or temporarily suspend activities for environmental, safety, conservation, weather, regulatory, or force majeure reasons.

If unforeseen operational issues arise (technical failures, logistical emergencies, safety concerns), Galápagos Below may reschedule or cancel an activity. A comparable alternative will be offered, or a refund of the amount actually paid will be issued.

Some activities require a minimum number of Participants. If this minimum is not met, Galápagos Below may cancel the activity up to 24 hours prior and offer an equivalent alternative or a refund.

The Participant may request changes to the date, time, or type of activity after the reservation has been confirmed. Galápagos Below will evaluate such requests based on availability and operational feasibility. Approved changes will be processed at no additional cost, unless the modification results in a price difference. If the change cannot be accommodated, the standard cancellation policy in Clause 5.4 will apply.
El Participante podrá solicitar cambios de fecha, hora o tipo de actividad tras confirmar la reserva. Galápagos Below evaluará dichas solicitudes según disponibilidad y viabilidad operativa. Los cambios aprobados se tramitarán sin coste adicional, salvo que la modificación suponga una diferencia de precio. Si el cambio no es posible, se aplicará la política de cancelación estándar de la cláusula 5.4.

No refund is guaranteed if an extraordinary event beyond the control of both parties prevents the execution of the contracted activity. These events may include: official weather alerts or navigational restrictions; natural phenomena (earthquakes, eruptions, tsunamis, etc.); restrictions issued by the environmental authority; flight or transportation cancellations; pandemics or government-mandated restrictions.
No se garantiza ningún reembolso si un acontecimiento extraordinario, ajeno al control de ambas partes, impide la ejecución de la actividad contratada. 5.6 Galápagos Below strongly recommends that Participants purchase travel insurance that covers cancellations, medical emergencies, and unforeseen events.

5.7 Refunds approved under these Terms will be processed within 14 days of formal cancellation.

5.9 Failure to use any included service (e.g., not attending a dive, not using included transportation) does not entitle the Participant to a partial refund, unless the omission is due to non-compliance by Galápagos Below.

Once a course has been assigned to a student and registered under applicable training agency standards (such as PADI), no refunds, credits, or transfers will be granted. This applies in particular to courses that include access to official e-learning or digital training materials, as these are individually issued, personalized to the student, and strictly non-transferable. Upon course assignment, the personal training record, online learning access, and certification tracking are activated within the agency's system and cannot be reused, reassigned, or revoked. Any course that has been issued or activated is considered delivered in its digital and administrative components, regardless of whether the student completes the practical or in-water portions.

6.1 The Participant must provide all required information (full name, passport number, contact details, accommodation, relevant medical conditions, allergies, etc.) at least 24 hours before the scheduled activity.

6.3 Participants are strongly encouraged to hold travel insurance that covers accidents, illness, cancellations, personal belongings, and — if participating in diving activities — underwater emergencies.

6.6 Any perceived defects or non-compliance in the service must be reported immediately to Galápagos Below or the guide on site to allow corrective measures.

6.6 Wahrgenommene Mängel oder Nichterfüllung des Dienstes müssen sofort Galápagos Below oder dem vor Ort anwesenden Guide gemeldet werden, um Korrekturmaßnahmen zu ermöglichen.
7.1 Continued participation is subject to the Participant's appropriate behavior and respect for safety, environmental, and coexistence rules.
7.1 La continuación de la participación está condicionada a un comportamiento apropiado del Participante y al respeto de las normas de seguridad, medioambientales y de convivencia.
7.1 Die weitere Teilnahme setzt ein angemessenes Verhalten des Teilnehmers sowie die Einhaltung von Sicherheits-, Umwelt- und Gemeinschaftsregeln voraus.
7.2 Guides or instructors have authority to suspend, restrict, or remove a Participant from the activity if they: (a) show signs of intoxication (alcohol or drugs); (b) ignore technical or safety instructions; (c) jeopardize the well-being of the group or operational team; (d) violate Galápagos National Park rules; (e) display violent, discriminatory, or disrespectful conduct.
7.2 Los guías o instructores tienen autoridad para suspender, restringir o expulsar a un Participante de la actividad si: (a) muestra signos de intoxicación (alcohol o drogas); (b) ignora instrucciones técnicas o de seguridad; (c) pone en peligro el bienestar del grupo o del equipo operativo; (d) viola las normas del Parque Nacional Galápagos; (e) muestra conducta violenta, discriminatoria o irrespetuosa.
7.2 Guides oder Instruktoren haben die Befugnis, einen Teilnehmer von der Aktivität auszuschließen, einzuschränken oder zu entfernen, wenn dieser: (a) Anzeichen von Berauschung (Alkohol oder Drogen) zeigt; (b) technische oder Sicherheitsanweisungen ignoriert; (c) das Wohlbefinden der Gruppe oder des Betriebsteams gefährdet; (d) Nationalpark-Regeln verletzt; (e) gewalttätiges, diskriminierendes oder respektloses Verhalten zeigt.
7.3 Removal due to misconduct may occur even during the activity (including on the boat or at sea) without any right to refund.

8.1 The Participant is responsible for ensuring they are in appropriate physical and mental condition for the contracted activity. Galápagos Below may request a medical certificate or deny participation if minimum safety or fitness requirements are not met.

8.2 Any medical condition, allergy, injury, medication, or dietary requirement must be disclosed in advance.

8.3 For diving courses, established safety standards and procedures of the relevant international certification body (e.g., PADI) apply at all times.

9.1 Galápagos Below is not liable for material loss, theft, damage to personal belongings, physical injury, or delays occurring during the provision of services, except in cases of proven negligence on the part of Galápagos Below or its staff.

10.1 All content produced by Galápagos Below — including but not limited to text, images, videos, manuals, signage, educational materials, and digital content — is the intellectual property of Galápagos Below and may not be reproduced, distributed, or used for commercial purposes without explicit written authorization.

11.1 Any complaint, claim, or disagreement must be submitted in writing within 48 hours after the completion of the service.

12.1 These Terms and Conditions are governed by the laws of the Republic of Ecuador, including the Organic Law of Tourism, the Adventure Tourism Regulations, and the provisions of the Galápagos National Park and the Special Legal Regime of the province.

14.1 The Participant acknowledges and accepts that adventure activities and diving involve inherent risks, even when all safety protocols are followed. These risks may include, but are not limited to: changing weather and sea conditions; encounters with marine wildlife; physical injuries due to falls, impacts, or fatigue; physiological reactions to diving (barotrauma, narcosis, etc.); unforeseen equipment or transportation failures; limitations in immediate medical assistance due to remote location.
14.1 El Participante reconoce y acepta que las actividades de aventura y el buceo conllevan riesgos inherentes, incluso cuando se siguen todos los protocolos de seguridad. Estos riesgos pueden incluir, sin limitarse a: condiciones climáticas y marítimas cambiantes; encuentros con fauna marina; lesiones físicas por caídas, impactos o fatiga; reacciones fisiológicas al buceo (barotrauma, narcosis, etc.); fallos imprevistos de equipos o transporte; limitaciones en la asistencia médica inmediata por la ubicación remota.

14.2 By participating, the Participant voluntarily assumes all associated risks and agrees to follow all instructions from guides, instructors, and operational staff before, during, and after the activity.

14.3 Galápagos Below shall not be liable for injuries, losses, or damages resulting from failure to follow safety instructions, undeclared medical conditions, or voluntary actions beyond the limits established by the technical team.

14.4 Participation in any activity implies the Participant's express waiver of any legal action for risks voluntarily assumed, except in cases of proven gross negligence by Galápagos Below.

15.1 Galápagos Below collects personal data for the purpose of managing reservations and operations. Participants have the right to request access, correction, or deletion of their data in accordance with applicable regulations.

15.2 By participating in activities, the Participant authorizes Galápagos Below to use photos and videos in which they appear for promotional purposes, without additional compensation. This authorization may be revoked for future use only (previously published material cannot be retroactively withdrawn).

By making a reservation with Galápagos Below — whether in person, electronically, or through an agency — the Participant acknowledges having read, understood, and accepted these Terms and Conditions in full. This document constitutes the entire agreement between the parties.
